Terms and Conditions for Wheelie Bin Hire

1. Introduction These Terms and Conditions govern the hire of wheelie bins from AMCO Waste & Building Management Ltd ("the Company"). By hiring a wheelie bin, the customer ("the Customer") agrees to comply with these terms.
2. Deposit A £14.40 deposit is required for the hire of each wheelie bin. This deposit must be paid in full prior to the delivery of the wheelie bin. The deposit will be refunded upon termination of the service, provided the bin is returned in good condition.
3. Collection Charges The Company charges £12.00 plus VAT per collection. The Customer can choose between weekly or fortnightly collections. Collection schedules will be agreed upon at the time of hire.
4. Payment Terms All payments, including the initial deposit and collection charges, must be made in accordance with the Company's invoicing terms. Invoices are due for payment within 30 days of the invoice date. Late payments may incur additional charges.
5. Bin Usage

The bin lid must be able to close tightly and remain closed at all times.

If there is too much waste to fit in the wheelie bin, the excess waste must be placed in refuse sacks and left next to the wheelie bin. There will be a £3 charge plus VAT per refuse sack for the collection of additional waste.

The Customer is responsible for ensuring that the bin is accessible for collection on the designated days.
6. Responsibilities

The Customer is responsible for any damage or loss of the wheelie bin during the hire period.

The Company reserves the right to charge for any damage beyond normal wear and tear.
7. Termination

Either party may terminate the agreement with one month's written notice.

Upon termination, the Customer must ensure the wheelie bin is returned in good condition. The deposit will be refunded subject to the condition of the bin.
8. Legal Compliance All waste must be disposed of in accordance with local regulations and laws. The Company ensures that all collected waste is disposed of legally and in an environmentally responsible manner.
9. Amendments The Company reserves the right to amend these terms and conditions at any time. Any changes will be communicated to the Customer in writing.
10. Customer Obligations The Customer must ensure that no hazardous waste is placed in the wheelie bin. The Company reserves the right to refuse collection if hazardous materials are detected.
11. Service Suspension The Company reserves the right to suspend the service if the Customer fails to comply with these terms and conditions.
12. Ownership The wheelie bin remains the property of the Company at all times. The Customer must not modify or alter the bin in any way.
13. Notice Any notice required or permitted to be given by either party to the other under these terms shall be in writing and addressed to the other party’s principal place of business.
14. Entire Agreement These terms and conditions constitute the entire agreement between the Company and the Customer and supersede any prior agreements or understandings.
15. Severability If any provision of these terms and conditions is found to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable.
16. Assignment The Customer may not transfer or assign any of its rights or obligations under these terms and conditions without the prior written consent of the Company.
17. Confidentiality Both parties agree to keep all information obtained under these terms and conditions confidential and not to disclose such information to any third party without the other party’s prior written consent.
18. Data Protection The Company will comply with all applicable data protection laws in relation to the Customer's personal data.
19. Indemnity The Customer agrees to indemnify and hold the Company harmless from any claims, losses, or damages arising from the Customer’s breach of these terms and conditions.
20. Waiver No waiver by the Company of any breach of these terms and conditions by the Customer shall be considered as a waiver of any subsequent breach of the same or any other provision.
21. Force Majeure The Company shall not be liable for any failure to perform its obligations under these terms due to circumstances beyond its reasonable control, including but not limited to acts of God, war, and natural disasters.
